Legal
Terms
The terms on which we provide this website, our funeral services, and access to funeral cover. We have kept them short and in plain language, as the law requires and as decency suggests.

1Who you are dealing with
This website is operated by SamWill Enterprises t/a SamWill Funeral Service, registration 2024/442945/07. Our full company and licence details are on the who we are page.
2Two different things, governed differently
The funeral service is provided by us. That agreement is between you and SamWill.
The funeral policy is a contract of insurance between you and Safrican Insurance Company Limited, administered by AMOR BROKERS (FSP 52097). We are not the insurer. The policy document the insurer issues governs that cover, and where anything on this website differs from it, the policy document prevails.
3What this website is
Information, and a means of applying for cover. We keep it accurate and current, but plan details, premiums and benefits may change, and nothing here is a substitute for the policy document.
Nothing on this website is financial advice. See clause 3 of the disclosure page.
4Applying for cover
Before you submit, you are shown a summary of everything you have entered and may go back and correct any of it. Submitting an application is not acceptance — the insurer decides whether to accept it, and cover starts only once it does and the first premium is collected.
You must give accurate information. A policy can be declined, or a claim refused, if material information was wrong or withheld — particularly an identity number, an age, or the identity of a person being insured.
Safrican Insurance Company Limited requires a copy of the identity document of every person you are insuring and of your beneficiary — an ID for adults, a birth certificate for children, or a passport for a permanent resident — together with your beneficiary’s ID number. An application without them cannot be submitted.
You may cancel a new policy within 31 days of receiving the policy document. See clause 6 of the disclosure page.
5Premiums
Premiums are collected monthly by debit order, on the debit day you choose. The debit order mandate you sign when you apply is your authority for us to collect it. We do not accept cash.
If a premium is not collected, it is added to your next debit order: one missed month means a double premium the following month, and two missed months a triple premium. If three months’ premiums remain unpaid, the policy lapses. We will try to reach you before that happens.
6Funeral services
Where we conduct a funeral, we will agree with you in advance what is included and what it costs, in writing. Anything added afterwards is agreed and priced before we do it.
Some things are outside our control — the release of a body by a state mortuary, documentation from Home Affairs, a grave allocation, or weather. We will tell you promptly if any of them affects your arrangements.
The ceremonial elements shown in our photographs, such as honour guards, bands or processions, are arranged for particular families and are not included in any plan unless we have agreed it with you in writing.
7Your information
How we handle your information is set out in the privacy notice. To check your cover or change your details, telephone us on 021 203 5379.
8What we are responsible for
We are responsible for doing what we have agreed to do, with the care and skill you are entitled to expect of a professional funeral director. Nothing in these terms limits any right you have under the Consumer Protection Act, or excludes liability for death, personal injury or fraud.
We are not responsible for the acts of the insurer, or of a third party you engage directly.
9Complaints, and the law that applies
Please see the complaints page. These terms are governed by South African law.
10Changes
We may update these terms. The date at the top of this page tells you when they last changed. Material changes affecting an existing policy will be communicated to you directly, not merely posted here.
